Since the America Invents Act’s new post-grant procedures were implemented in 2012, Haynes and Boone’s Intellectual Property (IP) Practice has been a leader in helping clients protect their patents and invalidate others’ claims both at the U.S. Patent and Trademark Office (USPTO) and in concurrent patent litigation in the federal courts.

Haynes and Boone lawyers have been involved in over 200 IPR and CBM proceedings before the PTAB, most of which involve patents that are concurrently involved in litigation. In fact, of the top 20 law firms filing IPRs on behalf of the Petitioner, Haynes and Boone has the highest institution rate (93 percent) and the highest final decision rate (91 percent) for canceling claims (Docket Alarm, 2017).
